This depends on the setting in the parameter Restrict Time-Off Requests to no more than Projected Accrued or Current Available Balance
I would like to enable this by CODE - so leave that they do not accrue can be requested - ie: Compassionate Leave
The message - You cannot request more timeoff than you have earned. will only come up for codes we specify
Currently to allow this request we have to turn off the parameter for ALL codes.

Agreed. Certain Leave Codes have concept to borrow against and some do not. With some set for accrual and some set for fixed amount, projections may or may not help and taking against more would be on a Leave Code level not system overall.
